This agreement (the “Agreement”) is between the Global Data Protection Agency Pty Ltd (the “Company”) and the Affiliate (“you”). The terms and conditions set forth in this Agreement shall govern your participation in the Company’s affiliate program (the “Affiliate Program”).

1. Enrollment in the Affiliate Program

1.1 You can apply to become an Affiliate by completing the online application form available on the Company’s website.

1.2 The Company reserves the right to reject any application without explanation.

1.3 You represent and warrant that all the information you provide in your application is true, accurate, and complete.

2. Affiliate Links

2.1 Once your application is accepted, you will be given a unique Affiliate link that you can place on your website or social media platforms.

2.2 You agree to only use the Affiliate link provided to you by the Company.

2.3 You may not modify, adapt, or change the Affiliate link in any way.

2.4 You may not use the Affiliate link for any purpose other than promoting the Company’s products or services.

3. Commissions

3.1 You will earn a commission on the net sales of products or services sold through your Affiliate link.

3.2 The commission rate and payment terms are subject to change at any time without notice.

3.3 The Company reserves the right to withhold payment of commissions for any reason, including but not limited to fraud, chargebacks, or violation of this Agreement.

3.4 The Company will not pay commissions on sales that are made through the Affiliate link but later refunded or cancelled.

4. Promotion of the Company

4.1 You agree to promote the Company’s products and services in a truthful and honest manner.

4.2 You may not engage in any deceptive or misleading advertising practices or make any false claims about the Company’s products or services.

4.3 You agree to comply with all applicable laws, regulations, and industry standards related to advertising, marketing, and promotions.

5. Intellectual Property

5.1 The Company grants you a limited, non-exclusive, non-transferable license to use the Company’s trademarks, logos, and other intellectual property solely for the purpose of promoting the Company’s products and services.

5.2 You may not use the Company’s intellectual property in any way that is inconsistent with this Agreement or that infringes upon the Company’s rights.

6. Termination

6.1 Either party may terminate this Agreement at any time, for any reason, upon written notice to the other party.

6.2 Upon termination, you agree to immediately cease all use of the Affiliate link and the Company’s intellectual property.

7. Limitation of Liability

7.1 The Company will not be liable for any damages, including but not limited to direct, indirect, incidental, punitive, or consequential damages, arising from your participation in the Affiliate Program.

7.2 You agree to indemnify and hold harmless the Company, its officers, directors, employees, agents, and affiliates, from and against any claims, damages, liabilities, costs, and expenses, including but not limited to attorneys’ fees, arising from your participation in the Affiliate Program.

8. Governing Law

8.1 This Agreement shall be governed by and construed in accordance with the laws of Victoria, Australia.

8.2 Any dispute arising from or related to this Agreement shall be resolved exclusively in the state or federal courts located in [insert your city/region].

9. Entire Agreement

9.1 This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements and understandings, whether written or oral.

9.2 This Agreement may

be amended or modified by the Company at any time, without notice, and any such amendment or modification shall be binding upon you.

9.3 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
